Try to turn off the recycling bin and then delete that folder ($RECYCLE.BIN).
Recycling bin can be turned off by right clicking on it -> Properties.
The hidden recycling bin folder can be exposed from Folder Options, like this:

From the error message, it sounds like an ACL issue.
